These Terms and Conditions govern your use of the Onyx Local website and services.
By accessing this website or purchasing any services from Onyx Local, you agree to be bound by these Terms.
If you do not agree, you may not use our services.
“You”, “User”, or “Client” refers to any person or business using our services.
“Company”, “We”, “Us”, or “Our” refers to Onyx Local.
Onyx Local provides lead generation services for remodeling companies, including:
• Facebook and digital advertising campaigns
• Lead capture systems
• AI-assisted and/or manual lead qualification processes
• Call handling and routing systems
• Appointment setting and lead delivery
All services are provided on a month-to-month basis and may be cancelled at any time by either party.
A “qualified lead” is defined as a homeowner who:
• is seeking a relevant remodeling service (e.g., kitchen, bathroom, additions)
• is located within the Client’s service area
• has a realistic budget (minimum threshold determined by Onyx Local)
• has an active timeline to move forward
Onyx Local reserves the right to determine whether a lead meets these criteria.
Onyx Local guarantees a minimum of five (5) qualified leads per billing cycle.
If this minimum is not met, the Client may request a refund for that billing cycle. Refund requests must be submitted in writing within seven (7) days after the end of the billing cycle.
Refunds are not automatic and will be issued only after verification that the minimum lead requirement was not fulfilled.
Ad spend is not included in any refund and remains the sole responsibility of the Client.
This guarantee applies only if the Client:
• responds to leads in a timely manner
• maintains reasonable availability to handle inquiries
• does not materially change services, pricing, or service area during the campaign
• provides required assets (e.g., images, videos, offers) when requested
The guarantee does not apply if these conditions are not met.
Onyx Local guarantees the delivery of qualified leads only.
Onyx Local does not guarantee:
• booked appointments
• estimates
• closed deals
• revenue increases
Final results depend on the Client’s sales process, pricing, and follow-up.
Services are billed monthly in advance.
Lead generation services are billed for the delivery of qualified opportunities, not for closed sales or revenue outcomes.
Failure to make payment may result in:
• suspension of services
• pausing of campaigns
Onyx Local reserves the right to charge a reactivation fee after suspension due to non-payment.
Clients may cancel services at any time.
Cancellation stops future billing but does not retroactively refund work already performed.
Onyx Local reserves the right to suspend or terminate services at any time due to:
• non-payment
• misuse of services
• abusive conduct
• legal or reputational risk
Onyx Local is not responsible for performance impacts resulting from service suspension.
The Client agrees to:
• respond to leads promptly
• maintain accurate business information
• provide necessary assets and cooperation
• act in good faith when evaluating lead quality
Failure to meet these responsibilities may affect results and void performance guarantees.
Clients retain ownership of:
• their business
• branding
• original content they provide
Onyx Local retains ownership of:
• proprietary systems
• ad strategies
• qualification processes
• automation workflows
Lead generation systems, ad campaigns, automation workflows, and configurations created by Onyx Local remain the property of Onyx Local unless otherwise agreed in writing.
Access to systems may be revoked upon termination of services.
Onyx Local may use employees, contractors, or third-party specialists to deliver services.
All work remains under the responsibility of Onyx Local.
To the fullest extent permitted by law, Onyx Local shall not be liable for:
• loss of revenue
• business interruption
• indirect or consequential damages
Total liability shall not exceed the amount paid for services in the previous 30 days.
Nothing in these Terms creates:
• an employment relationship
• a partnership
• a joint venture
These Terms are governed by the laws of the State of Florida.
Any disputes shall be handled exclusively in Broward County, Florida.
Onyx Local may update these Terms at any time.
Continued use of services constitutes acceptance of updates.
These Terms constitute the entire agreement between you and Onyx Local.
By using our services, you acknowledge that you have read and agreed to these Terms.
